1. Acceptance of Terms

By downloading, installing, or using the Socitti Samui application ("the App"), you accept and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and GLIA HONG KONG HOLDINGS CO., LIMITED ("Company", "we", "us", "our"), the operator of the Socitti Samui application. The App is produced under the Socitti brand, in partnership with Samui Beach Club.

The App is owned and operated from Hong Kong and is governed by the laws of the Hong Kong Special Administrative Region.

2. Description of Service

Socitti Samui is a iOS app (Android to follow) and destination concierge for Koh Samui, Thailand. The App provides editorial content, venue and beach information, event and offer listings, weather and conditions data, trip planning checklists, offline reference material, and local travel guidance. Content is provided in partnership with Samui Beach Club.

The App lets you send enquiries to venues through Samui Beach Club. We aren't a party to anything you arrange with a venue.

The App is an informational platform and destination concierge. We are not a booking agent, tour operator, venue operator, transport provider, or emergency service. Content is curated for general informational use and does not constitute professional travel, medical, legal, financial, immigration, or safety advice.

3. Access and Paid Products

The App is free to download. Most content requires a 30-Day Trip Pass, a one-time in-app purchase that doesn't renew. Your 30 days start on the trip start date you choose (no later than 60 days after purchase) or on the purchase date. Emergency, My Stay and your saved data are available without a pass. Purchases and refunds are handled by Apple under its terms; contact Apple for refunds. Restore your pass from the paywall or Profile.

4. User Eligibility

You must be at least 18 years of age to use the App. By using the App, you represent and warrant that you meet this age requirement.

5. Content Accuracy and Limitations

Information in the App, including venue details, event listings, offer terms, opening hours, prices, weather data, and editorial content, is provided for general guidance. We make reasonable efforts to ensure accuracy, but:

Information may be outdated, incomplete, or incorrect.
Venue details, events, and offers change frequently and should be confirmed directly with the venue or provider.
Weather and conditions data is sourced from third parties and is approximate.
Editorial content reflects the views of the authors and does not constitute endorsement.
Offline and cached content may not reflect the most current information.

We recommend confirming important details, particularly event times, prices, availability, and venue operating hours, directly with the relevant venue or provider before making plans.

6. Venue Enquiries

When you contact a venue you agree to provide accurate details and not to send spam, abuse or unlawful content. Venues decide whether and how to reply. Enquiries aren't bookings.

7. Acceptable Use

When using the App, you agree not to:

Violate any applicable laws or regulations
Attempt to gain unauthorised access to the App, its systems, or other users' data
Reverse-engineer, decompile, or disassemble the App
Scrape, mine, or harvest data from the App without permission
Use the App for any commercial purpose without our written consent
Impersonate any person or entity
Interfere with the operation, security, or performance of the App
Distribute malware or harmful code through or in connection with the App

8. Intellectual Property

8.1 Our Content

All content in the App, including text, graphics, logos, images, design, layout, and software, is owned by GLIA HONG KONG HOLDINGS CO., LIMITED or our licensors and is protected by Hong Kong and international copyright laws.

You may view and use the App for personal, non-commercial purposes. You may not reproduce, distribute, modify, create derivative works from, or commercially exploit any content without our prior written permission.

8.2 Venue Images

Images of venues are copyright of their respective owners and are used for promotional and informational purposes. Copyright holders may request image removal by contacting us.

8.3 Socitti and Samui Beach Club Trademarks

Socitti, Socitti Samui, Samui Beach Club, and associated logos and marks are trademarks of GLIA HONG KONG HOLDINGS CO., LIMITED or its licensors. You may not use these marks without our prior written consent.

9. Third-Party Services and Links

The App may contain links or references to third-party websites, services, venues, booking platforms, maps, weather providers, and other external resources. We do not control or endorse these third parties and are not responsible for their content, services, accuracy, or privacy practices.

Venue information, event details, and offers are provided by venues or collected from public sources. We recommend confirming details directly with the venue or provider.

The App uses the following third-party services, each of which operates under its own terms and privacy policy:

Apple App Store (distribution, purchases, and billing)
RevenueCat (pass and entitlement management)
Samui Beach Club (venue content and venue contact)
Apple App Attest
Google Places and Maps
PostHog (analytics, only if you opt in)
Third-party weather data providers
Google Play (Android, when available)

10. Device Permissions

The App may request the following optional device permissions:

Location. Used to provide location-relevant content such as nearby venues and local conditions. Location access is only used when you grant permission and can be changed at any time in your device settings.

Notifications. Used to send you reminders you choose, such as before your pass ends. Notification permission is requested separately and can be disabled at any time in your device settings.

You can use the App without granting either permission. Some features may be limited without location access.

11. Offline Content

The App may store bundled and reference content locally on your device for offline access. Offline content may not reflect the most current information. Images, map tiles, live data, external links, and certain features may still require an active internet connection.

12. Disclaimers

12.1 No Warranties

The App and its content are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

12.2 No Professional Advice

Content in the App does not constitute professional travel, medical, health, legal, financial, immigration, or safety advice. The App is not a substitute for local emergency services, professional guidance, or official government travel advisories.

12.3 External Factors

We are not responsible for weather conditions or natural events, political situations or travel restrictions, venue closures or changes, transportation disruptions, personal injury or property damage, or any loss arising from decisions made based on App content.

12.4 Safety

Weather, sea and UV information is a forecast estimate. Always follow beach flags, lifeguards and local authorities. In an emergency call 1669 (medical) or 191 (police).

13. Limitation of Liability

13.1 General Limitations

To the maximum extent permitted by Hong Kong law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, loss of profits, revenue, or business opportunities, loss of data or information, personal injury or property damage, or any decisions made based on information in the App.

13.2 Maximum Liability

Our total liability to you for all claims shall not exceed HKD 1,000 or the price you paid for your current pass, whichever is greater.

13.3 Exceptions

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability that cannot be excluded by Hong Kong law.

14. Indemnification

You agree to indemnify, defend, and hold harmless GLIA HONG KONG HOLDINGS CO., LIMITED, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the App, your violation of these Terms, your violation of any rights of another party, or your breach of applicable laws.

15. Modifications

15.1 App Changes

We reserve the right to modify, update, suspend, or discontinue the App or any of its features at any time without notice. We are not liable for any modification, suspension, or discontinuance of the App.

15.2 Terms Updates

We may update these Terms at any time. Changes are effective when posted within the App. Material changes will be notified via prominent notice in the App. Your continued use after changes constitutes acceptance.

16. Governing Law and Dispute Resolution

16.1 Governing Law

These Terms are governed by the laws of the Hong Kong Special Administrative Region, without regard to conflict of law principles.

16.2 Jurisdiction

You agree to submit to the exclusive jurisdiction of the courts of Hong Kong for resolution of any disputes.

16.3 Dispute Resolution

Before initiating legal proceedings, contact us to attempt informal resolution, provide written notice describing the dispute, and allow 30 days for good-faith negotiations.

If you're a consumer in the EU or UK, you also keep the protection of the mandatory consumer laws of your country of residence.

17. Severability

If any provision of these Terms is found invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it valid, or severed if modification is not possible. The remaining provisions shall remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy and Data and Consent Policy, constitute the entire agreement between you and GLIA HONG KONG HOLDINGS CO., LIMITED regarding use of the App.

19. Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

20. Assignment

You may not assign or transfer these Terms. We may assign our rights and obligations without restriction.

21. Survival

Provisions that by their nature should survive termination, including liability limitations, indemnification, intellectual property, and dispute resolution, shall survive.

23. Acknowledgement

By using the Socitti Samui application, you acknowledge that you have read and understood these Terms, you agree to be bound by these Terms, you have read and understood our Privacy Policy and Data and Consent Policy, you are legally capable of entering into binding contracts, and you will comply with all applicable laws.
